Is Monero legal? The situation in October 2026

In most countries it is legal to own Monero and keep it in your own wallet. What many governments restrict is licensed exchanges and crypto businesses offering it: the EU from 10 July 2027, and already South Korea, Japan, the UAE, India, Thailand and the Philippines. A few countries ban crypto trading of any kind.

Quick facts

In almost every country we track, yes: no law bans holding XMR in your own wallet. A few countries ban crypto altogether.
Why do exchanges delist Monero?
Anti-money-laundering rules make it hard for licensed firms to trace XMR transfers, so many have dropped it rather than risk their licences.

The short answer

We know of no country that has a law singling out private ownership of Monero. Rules almost always target businesses: exchanges, brokers and wallet providers that hold customers' money. That limits where you can buy or sell XMR, not whether you can keep it.

The exceptions are countries that ban or do not allow cryptocurrency trading in general, where the position of any crypto, Monero included, is unclear or worse. This page is general information, not legal advice. Check your own country on the country pages before you buy.

The four levels of restriction

LevelWhat it meansExamples (October 2026)
No specific ruleOwning and trading XMR is legal; availability depends on which platforms choose to list itUnited States, Switzerland, Brazil, Mexico, Singapore, South Africa, Turkey
Exchanges have dropped itLegal to own, but mainstream regulated platforms no longer offer itUnited Kingdom, Canada
Licensed providers barredA law or regulator stops licensed crypto firms handling privacy coins; private holding is not bannedSouth Korea (March 2021), Thailand (April 2022), Dubai and Abu Dhabi, India (January 2026), Philippines (June 2026), EU from 10 July 2027
Crypto restricted overallNo lawful local market for any cryptocurrency; holding is a grey areaChina, Egypt, Morocco, Saudi Arabia (unclear)

Japan sits between levels two and three: registered Japanese exchanges have not offered XMR since regulators pressed them in 2018, but there is no statute naming privacy coins. Russia's new licensed market, which opened on 1 September 2026, is designed to exclude anonymous coins.

Key regions in more detail

European Union

Two EU laws matter. Under MiCA Article 76(3), which applies since 30 December 2024, licensed trading platforms must not admit crypto-assets with an inbuilt anonymisation function unless holders and transaction history can be identified. Under Article 79(1) of the Anti-Money Laundering Regulation (EU) 2024/1624, from 10 July 2027 credit institutions, financial institutions and crypto-asset service providers may not keep accounts that allow anonymisation, "including through anonymity-enhancing coins". Neither law bans individuals from holding XMR in their own wallets. Full explanation: EU privacy coin ban 2027.

United States

No federal rule bans Monero. Coinbase does not list it; its chief executive said in July 2020 that this was because of regulatory concerns. Kraken still offers XMR to US clients, and its co-CEO said on 24 October 2026, when withdrawing questionnaires about Monero withdrawals, that "XMR stays listed". The IRS awarded contracts worth up to $1.25 million to Chainalysis and Integra FEC in September 2020 to develop Monero tracing tools, which shows authorities expect people to use it and expect to investigate it.

United Kingdom

Legal to own. Kraken stopped XMR trading and deposits for UK customers after 26 November 2021, and a March 2026 CCN survey found that FCA registration and AML expectations lead platforms to avoid privacy coins.

Asia and the Middle East

  • South Korea: amendments to the Special Financial Transactions Act in force since 25 March 2021 bar licensed exchanges from handling "dark coins" such as XMR.
  • India: on 22 January 2026 it was reported that the Financial Intelligence Unit had told registered platforms to stop transactions in anonymity-enhancing tokens. Kraken followed for Indian clients from 10 April 2026.
  • United Arab Emirates: Dubai's VARA prohibited activities related to anonymity-enhanced cryptocurrencies in February 2023; Abu Dhabi (June 2025) and the DIFC (12 January 2026) followed. Personal non-custodial holding is not prohibited by these rules.
  • Philippines: central bank memorandum M-2026-023 (June 2026) bars licensed providers from listing privacy coins.
  • Self-custody. Keeping XMR in a wallet you control, such as Feather or Cake Wallet.
  • Running a node or mining, subject to normal tax rules on mining income.
  • Peer-to-peer trades between individuals, where your country allows crypto trading at all. Business-scale trading can require a licence. See buying Monero without KYC for what is legal and the scams to avoid.

Legal to own does not mean anything goes. Tax still applies (see Monero taxes), and using any currency to hide crime is illegal everywhere. We do not give advice on avoiding sanctions, identity checks or tax.

Exchange delistings are not bans

Many headlines say "Monero banned" when an exchange delists it. Binance's worldwide removal on 20 February 2024, OKX's on 5 January 2024 and Kraken's regional exits were business or compliance decisions, not laws against owning XMR. The Monero delisting tracker lists every dated event we have found, with sources. If your exchange is dropping XMR, follow what to do when your exchange delists Monero.

How to check your own country

  1. Open the country pages or use the country checker.
  2. Read the official source cited there, such as the regulator's notice or the law on the government's website.
  3. Check whether your local exchanges list XMR today; this changes often.
  4. If you are unsure, ask a local lawyer or tax adviser. Rules move fast, and this page reflects October 2026.

Frequently asked questions

Is it illegal to own Monero?

In most countries, no. We found no country with a law banning private ownership of Monero specifically. Restrictions target exchanges and crypto businesses, plus a few countries that ban crypto trading in general.

Is Monero banned in the EU?

Not for individuals. MiCA already keeps it off licensed trading platforms, and from 10 July 2027 the AML Regulation bars crypto service providers from handling anonymity-enhancing coins. Holding XMR in your own wallet stays legal.

Is Monero legal in the United States?

Yes. There is no federal ban. Few large US platforms offer it, and normal tax rules apply to gains and mining income.

Why do governments restrict Monero?

Regulators say privacy coins make anti-money-laundering checks harder because transactions cannot be traced on the blockchain. Supporters argue financial privacy is a legitimate right. Most rules therefore target regulated businesses rather than users.

Is using a peer-to-peer market legal?

In many countries trading between individuals is legal, but rules differ, and regular or large-scale trading can count as a business that needs a licence. Check your country page before trading.
