The legal situation in Malaysia

Malaysia allows crypto trading only on SC-registered digital asset exchanges, which may list only SC-approved assets (15 as of mid-2025). A June 2025 SC consultation singled out privacy coins as a higher-risk asset type, but no explicit ban was found, and we could not confirm XMR on any registered exchange. Owning XMR is legal.

Key facts

  • 2019-01-31: The SC's digital asset exchange (DAX) framework began; six DAX operators are registered.
  • 2025-06-30: SC consultation paper 3/2025 proposed easing listing rules and flagged privacy coins as a higher-risk asset type for money-laundering concerns.
  • The SC had approved 15 tradeable digital assets, including Bitcoin and Ethereum, as of mid-2025.
  • Tax: Casual investing is generally untaxed; frequent trading may be business income.
